In Spain, the profession of PRIVATE DETECTIVE is regulated by Law 05/2014, of April 4, on PRIVATE SECURITY.
Article 48.1 states: "The private investigation services, carried out by private detectives, shall consist of carrying out the investigations that are necessary to obtain and provide, on behalf of legitimated third parties, information and evidence on private conduct or facts related to the following aspects:
- Those related to the economic, labor, commercial, financial and, in general, to personal, family or social life, except that which takes place in the domiciles or reserved places.
- Obtaining information aimed at guaranteeing the normal development of the activities that take place in fairs, hotels, exhibitions, shows, contests, conventions, large commercial areas, public premises of great concurrence or similar areas.
- The conduct of inquiries and the obtaining of information and evidence relating to crimes that can only be prosecuted at the request of a party on behalf of the subjects legitimized in the criminal proceedings."
Therefore, the aforementioned law exclusively empowers private detectives to carry out private investigations, in order to obtain and provide evidence and information in a legal manner, on private conduct or facts in the commercial, labor, economic, and personal and family life. These inquiries obtained during the process will be reflected in a report with full judicial validity.
All investigations carried out will always be governed by the principles of:
- Discretion
- Proportionality
- Legality
